I have been arrested, what do I do?
The first thing you should do is confirm that it is not a case of mistaken identity. Police are required to obtain an arrest warrant before they deprive a citizen of his or her liberty, but sometimes that is not the case. The best general advice in these matters is to call for the services of an attorney. Remember that if you are arrested you have the right to ask for a court appointed attorney if you are unable to hire one yourself. Remember also the words of Abraham Lincoln, who once said that he who represents himself has a fool for a client. I was cheated in a commercial deal, should I sue?
The ideal would be that misunderstandings or deception never occur in the world, but unfortunately they do. Sometimes the only recourse is a lawsuit, but there are also alternative mediation possibilities in some cases. Depending on whether or not you are victim of a fraud, or a mass fraud, there may be several courses of action for you to take. I want a divorce, can I take my spouse to the cleaners for being bad to me?
Texas is a community property state, and whatever a person owned before the marriage is usually something that can be kept after a divorce. Most courts will grant an equitable division of assets acquired after marriage if the parties are not able to reach a property settlement agreement. Other factors, like children or a child on the way, can greatly alter the landscape of a property dispute. Divorce is a drastic step, and sometimes may seem necessary. Sometimes counseling is able to solve the problem. sometimes not. If you feel that there is no alternative but separation and divorce, there is a lot more involved than just the expense. Issues such as safety and security may require third party intervention. Please make an appointment with your attorney of choice and see what options there may be. Can an attorney or his representative contact me to offer legal services or do I need to make the first call?
It is your attorney's duty to advise you as to your best interests, but the responsibility to seek and select professional legal counsel is and properly must always be yours and yours alone. This is a strict ethical point. Unless you initiate the contact about possibly hiring a law firm or attorney, no attorney or law firm can call you to offer legal services pertaining to a specific past event or occurrence or series of events or occurrences, or any legal situation that the attorney is aware of pertaining to you in particular. You need to make the initial contact about possible employment of the law firm or attorney.
